Lesbian who sued over prom talks about gay bullies

The lesbian who successfully challenged a rural Mississippi school district’s ban on same-sex prom dates says she wept when she read about the recent spate of gay teen suicides linked to harassment.

Constance McMillen, who was recently named one of Glamour magazine’s “Women of the Year 2010,” told The Associated Press that she became a bullying victim after she challenged the Itawamba School District over a policy that prohibited her from bringing her girlfriend to the prom and wearing a tuxedo.

McMillen, 18, said she became emotional after reading about the suicides of 13-year-old Seth Walsh, of California, who hanged himself outside his home after enduring taunts from classmates, and of Tyler Clementi, an 18-year-old Rutgers University freshman who killed himself after his sexual encounter was secretly streamed online.

“I read it on Facebook. I was so upset about this that I could not sleep,” McMillen said. “I knew it had to be terrible for them to choose death as a way to escape what they were living in.”

McMillen said she has had her own suicidal thoughts.

“But I never really considered it to the point where I almost did it,” she said. “Everybody thinks about it when times get hard.”

Growing up in the small town of Fulton, Miss., McMillen said she wasn’t bullied until school officials canceled the prom rather than allow McMillen and her girlfriend to attend as a couple.

“I went through a lot of harassment and bullying after the lawsuit, and I realized how bad it felt being in that position,” she said.

The American Civil Liberties Union sued the district, which paid $35,000 to settle the lawsuit and also agreed to follow a non-discrimination policy, though it argued such a policy was already in place.

Glamour magazine recently honored McMillen for her fight against intolerance, and she’s now in the company of entertainer Fergie, actress Julia Roberts, designer Donatella and Queen Rania of Jordan.

Cindi Leive, Glamour editor-in-chief, said McMillen was selected by an advisory panel of past honorees, including Jennifer Lopez and Katie Couric. The main measure for honorees is that they help make the world a better place for others, Leive said.

“We’ve seen such devastating proof this year of how tough it is for gay teens out there. To have someone like Constance stand up for who she is with dignity and pride, is a really meaningful thing for other young people to see. We respect her bravery and her example,” Leive said in an e-mail.

In a photo on the magazine’s website, McMillen is dressed in a tuxedo and a tiara and standing in her messy bedroom. A television movie about her case is also in the works.

McMillen said her family’s support helped her confront injustice.

“It seems like gay students catch a lot. It’s already a rough time in high school. Everybody wants to be accepted,” McMillen said. “The family’s acceptance is 100 times more important than people they go to school with. Whenever their family doesn’t accept them, they feel like nobody’s going to.”

Producer Craig Zadan on Making a TV Movie About Prom-Bullied Constance McMillen

Constance McMillenLast February, 18 year old Constance McMillen made national headlines when the Itawamba County school board refused to allow her to wear a tuxedo and bring her lesbian partner to the Itawamba County Agricultural High School prom. McMillen brought in the ACLU to fight back and the board cancelled the prom. Constance was subjected to intense bullying at the school and on Facebook from students, parents and hordes of antigay attackers outside the small Mississippi town, about 20 miles east of Tupelo.

Despite fears of retribution, the young lesbian stuck by her right to freedom of expression and became a reluctant hero. “My daddy told me that I needed to show them that I’m still proud of who I am,” McMillen said at one point. “The fact that this will help people later on, that’s what’s helping me to go on.”

When openly gay Storyline Entertainment producing partners Craig Zadan and Neil Meron heard the story, they knew they had to try to make into a TV movie – as McMillen said – to hopefully help young people.

The producing team has a solid track record of going to the heart of a civil rights issue and changing hearts and minds by telling a story, including:

Serving in Silence: The Margarethe Cammermeyer Story, the gays-in-the-military story co-produced with Barbra Streisand and starring Glenn Close and Judy Davis; What Makes A Family, starring Brooke Shields and Cherry Jones about lesbian child custody; Wedding Wars, starring John Stamos, the first film about same sex marriage; Hairspray, the John Waters civil rights/integration story made into a musical starring John Travolta in the character made famous by Divine; and Cinderella, the TV retelling of the old favorite with African American singer Brandy as Cinderella, heading an intentionally racially diverse cast.

I spoke with Craig Zadan by phone late Thursday about the news that he and Meron are producing the McMillen story.  He was on the Atlanta set of yet another civil rights movie, Footloose, a re-make of the popular 1984 movie about youth culture confronting staid small town religion.  We talked about the timing of this TV movie for ABC Family – in which McMillen triumphs – at a time when gay teen bullying has become an epidemic.

When McMillen’s story first made news in February, Zadan said, “we started seeing reports on CNN and reading about it in the newspapers. Neil and I said this seemed like a very, very important subject to tackle and we went after it.” Told there were other producers vying to option the story, they said they really wanted an opportunity to “audition” for it.

District To Pay Lesbian Teen $35K Over Prom Dispute

A school district in rural Mississippi that canceled its prom rather than allow a lesbian student to attend with her girlfriend has agreed to pay $35,000 to settle a discrimination lawsuit the ACLU filed on her behalf.

The school district also agreed to follow a nondiscrimination policy as part of the settlement, though it argues such a policy was already in place.

Constance McMillen, 18, said the victory came at the price of her being shunned in her small hometown of Fulton.

A Real Hometown Hero & True Pioneer

You’ve all heard the story about Constance McMillen, the Itawamba, Mississippi high school student who was banned from attending her senior prom with her girlfriend and you’ve heard the controversy over fake proms, harassment and bullying.

Well, onto bigger and better things for this small town youth as she, along with many other LGBT youth received a prom with a little help from celebrities like Lance Bass and Ellen DeGenderes.  She was also invited (and accepted) to serve as one of the grand marshall’s in the NYC gay pride parade!

Lesbian who sued over prom date transfers schools

The lesbian who sued her rural school district over its ban of same-sex prom dates has transferred to a school in Mississippi’s capital. Constance McMillen told The Associated Press on Thursday that she now attends a high school in Jackson, about 180 miles from Itawamba Agricultural High School in Fulton.

ACTION ALERT! Stand with Constance! Sign the petition condemning the irresponsible actions of the Itawamba County School Board.

They canceled the prom to keep Constance from taking her girlfriend to prom.
They went to court to defend their bigoted policy.
Then they sent her to a “fake prom” while the rest of her class went to their OWN prom – to which she and her girlfriend weren’t invited.

You heard right. Parents in Constance McMillen’s Mississippi town organized a prom at a secret location, while she and her girlfriend were sent to a “prom” at a different venue – with just five other students.

Lesbian Prom Update

Constance McMillen’s case in Mississippi has felt a few legal bumps. Her high school banned Constance from bringing her girlfriend to prom and then canceled the prom because of the hubbub surrounding Constance’s protest. The ACLU attempted to force the school to hold the prom and permit Constance’s attendance with her date. A judge ruled against them.

The judge’s ruling found that Constance’s rights had been violated, but found that, since there was an alternative open prom organized, the community would be too confused by any further changes and the status quo could stand. The judge expressly stated that one foundation for his ruling was the fact that Constance was invited to the alternative prom.

Well, today we learn that Constance, in cruel high school form, was directed to a country club on prom night along with two other members of her class (both of whom have learning disabilities) while the rest of the school partied it up in a private prom-like party. The actions of the people organizing the prom were cruel and disgusting, but not illegal since the supervision and accountability acquired from a school-sponsored prom were absent from this celebration.

ABERDEEN, MS – A Mississippi federal court today ruled that school officials violated a lesbian student’s First Amendment rights when it canceled the high school prom rather than let the student attend with her girlfriend. The U.S. Court for the Northern District of Mississippi stopped short of ordering Itawamba Agricultural High School to put the school prom back on the calendar because of assurances that an alternative “private” prom being planned by parents would be open to all students. The American Civil Liberties Union had requested a preliminary injunction stopping the Itawamba County School District from canceling the prom and from prohibiting Constance McMillen from bringing her girlfriend as a date and wearing a tuxedo to the event.

Autostraddle: Prom Update

Clearly the world loves Constance McMillen just as much as her daddy and her girlfriend do. Not only has a New Orleans restaurant owner offered to bus & host the prom, but now the American Humanist Association has offered to plan and fund a prom for the Itawamba County Agricultural High School in Mississippi:

“It’s shameful that closed-minded members of the school board are prepared to deprive an entire class of students their prom over their outdated religious mores.” said Roy Speckhardt, Executive Director of the AHA. “People can hold to any belief or no belief in this nation, but the school board misuses their position when they try to impose their beliefs on the student population in Itawamba.”
