TW: child pornography, sexual assault/Anti-Gay Zealot Guilty of Child Pornography After Videotaping Daughter

A New Hampshire lawyer who works with a virulently anti-gay Christian-right organization has been found guilty of child pornography charges after videotaping her own daughter having sex with two men on multiple occasions. Lisa Biron, 43, of Manchester faces a minimum sentence of 25 years in prison after a jury convicted her yesterday. The jury deliberated for less than an hour.

Biron, arrested by the FBI last November, was accused of eight felony counts involving the videotaping of men having sex with a 14-year-old girl who was identified by the Associated Press as her daughter. She also allegedly made a cellphone video of herself having sex with her daughter. Biron, who claimed on her Facebook page (which was taken down, according to the Concord Monitor) that the Bible was her favorite book, had worked with Alliance Defending Freedom (ADF), formerly the Alliance Defense Fund, in defending a Pentecostal church in Concord in a tax fight against the city.

The Arizona-based ADF calls itself a “servant ministry” that seeks to transform the legal system and advocate “for religious liberty, the sanctity of life, and marriage and family.” The group issues dire warnings about “the homosexual agenda” and offers a book (available for a donation of $35) by its president, Alan Sears, and senior director Craig Osten, with that title. In the book, the authors claim that “the homosexual agenda” will destroy religious liberty and free speech. In one chapter, they claim that homosexuality on college campuses leads to pedophilia, and that homosexuality and pedophilia “are intrinsically linked,” a falsehood long perpetuated by the anti-gay right to demonize LGBT people.

In the wake of Biron’s arrest, the ADF removed all mentions of her from its website and Facebook page, and in a November “CBS News” report the ADF said that Biron was never an employee. The group has released no further statements on Biron. According to the LGBT blog Joe.My.God., the group continued to remove mentions of her from its Facebook page yesterday and banned anyone who posted anything about her.

Biron may not have been a formal employee of the ADF, but John Aravosis at Americablog found that she had been a member of the ADF “Honor Corps,” the group created to recognize allied attorneys who complete 450 hours of pro bono service for the group and to award and recognize “significant milestones” in service. Honor Corps attorneys also receive perks from the ADF like pro bono referrals and opportunities, job and résumé postings, invitations to their regional legal academies, and access to online resources and confidential updates and presentations. In March 2011, Biron was mentioned by the ADF as an “Allied Attorney Success Story.” The ADF website doesn’t list that anymore.

Soldier fighting DOMA will participate in New Hampshire inaugural ceremony

Last week (27 Dec.) New Hampshire Governor-Elect Maggie Hassan announced the details of her upcoming inaugural ceremony. Charlie Morgan, a chief warrant officer in the state’s National Guard, will open the ceremony by reciting the Pledge of Allegiance. Morgan, and her wife, are two of the plaintiffs involved in a lawsuit against the Defense of Marriage Act.

‘Charlie Morgan is a national treasure and a treasure to her home state of New Hampshire,’OutServe-SLDN executive director Allyson Robinsonsaid in a statement. ‘We could not be happier that Governor-elect Hassan has chosen to honor her work and her fight for equality in this way.’

OutServe-SLDN is a non-profit advocacy organization that works with LGBT military members, veterans and their families.

In 2008, Morgan was diagnosed with breast cancer. After undergoing a double mastectomy and rounds of therapy, she was cleared to serve. In 2010, Morgan did one year in Kuwait. However, when she returned it was discovered her cancer returned. It is now metastatic and incurable. The Concord Monitor reported Morgan’s doctors have given her months to live.

Because of DOMA, a federal law, Morgan’s spouse and four year old child will receive no survivor benefits. The statute, passed in 1996, prevents the US government from recognizing same-sex marriages even in states where such unions are legal (LGBT couples have been able to be married in New Hampshire since 2009). Couples also cannot file joint federal tax returns.

This past February Morgan took her case to the halls of Congress, specifically the office of Speaker of the House of Representatives John Boehner. She asked him to stop defending the law in the courts. The Republican leadership is leading the DOMA appeals to the Supreme Court.

First Gay Anglican Bishop Set to Retire

NEW Hampshire Episcopal Bishop Gene Robinson says he chafed for several years at being branded the first openly gay bishop of the Anglican Church until he realised he was wasting a pulpit from which he could advocate for equality.

“I’d been given this really remarkable opportunity and it would be selfish of me not to be the best steward of that opportunity,” he recently told The Associated Press in an interview as he prepares to retire in January. We went from my consecration, which set off this international controversy, to nine years later seeing gay, lesbian and transgender congregants welcome at all levels of the church, including bishop.”

Robinson’s election in 2003 as the first openly gay bishop in the Anglican Church created an international uproar and led conservative Episcopalians to break away from the main church in the United States. Robinson, 65, will hand the pastoral staff to his successor, A Robert Hirschfeld, in a ceremony at St Paul’s Episcopal Church in Concord on January 5.

Third Republican House Member Supports DOMA Repeal

Rep. Charles Bass of New Hampshire signed on to co-sponsor the Respect for Marriage Act, becoming the second Republican House member to express support within the past week.

Rep. Charles Bass of New Hampshire has become the third Republican House member and the second within the past week to support legislation that would repeal the Defense of Marriage Act and allow the federal government to recognize the legal marriages of same-sex couples.

Bass, who was defeated for re-election this year, did not release a statement about his decision to co-sponsor the measure known as the Respect for Marriage Act. Rep. Jerrold Nadler of New York, the original co-sponsor of the legislation, announced the development in a statement to The Advocate.

“I’m thrilled that Rep. Charlie Bass will be our newest GOP co-sponsor of the Respect for Marriage Act to repeal DOMA,” he said. “Rep. Bass is the second Republican in the past week to endorse equal protection for all Americans. Though he won’t be continuing his service in the next Congress, his commitment to equality and ending discrimination is truly appreciated.”

The move from Bass follows Rep. Richard Hanna of New York, who last week announced his support in terms of the Tenth Amendment and states’ rights. Both representatives hail from states with legislatures that have passed marriage equality.

New Hampshire’s first transgender representative signals fight back to office

A transgender New Hampshire state representative, who resigned last month, says she will stand again for election next year.

Stacie Laughton of Nashua, New Hampshire, quit just weeks after being elected when her criminal past was exposed by a local newspaper. The crimes dated back to several years ago, before Ms Laughton had transitioned from male to female, they included a 2008 conviction for conspiracy to commit credit card fraud and slashing tires.

The Laconia Daily Sun claimed the 28-year-old also admitted to faking an illness to get a ride from an ambulance. WMUR-TV reports earlier this week, the New Hampshire Executive Council scheduled a special election for April 2013. Ms Laughton said she’ll file as a candidate the day after Christmas.

In November, she had indicated her reluctance to resign from office, saying on Facebook:

“I didn’t want to have to do this, There’s been a lot of people that have said stay strong, keep your head up, stay in it. “It’s going to be difficult to be able to do that in this upcoming session, and to possibly face expulsion.”

Santorum Booed by New Hamphsire College Students on Gay Marriage

Antigay Republican presidential candidate Rick Santorum was booed during an exchange with a group of college students in Concord, N.H., over the same-sex marriage. New Hampshire is one of six states where marriage between same sex couples is legal.

Santorum said “230 years marriage has been between one man and woman. So if you want to change the law … you have to make the positive argument about why.” Once again, he compared marriage equality to polygamy. Buzzfeed reports on 17-year-old Rhiannon Pyle who challenged the candidate.

New Hampshire Equality Opponents ‘Trash’ Gay Families | thinkprogress.org

Conservatives working to overturn New Hampshire’s marriage equality law have published some particularly nasty banners on their new webpage, juxtaposing a heterosexual family with frivolous pictures from pride parades. The clear message is that only straight people have families, while the gay community is constantly out to “trash your values.”

These banners prove, once again, that conservatives are not just pursuing personal beliefs but seeking opportunities to smear and defame all of the LGBT community as disordered perverts:

In the northern state of New Hampshire today, Mitt Romney sat down with a 63-​year old man sporting a cap that read, “Vietnam Veteran” and things went south from there for the former Massachusetts Governor. The Vietnam Veteran, having breakfast at the Chez Vachon diner, is an Independent, and also gay, but Romney didn’t realize that. Veteran Bob Garon — gay, married, and having breakfast with his husband — asked Romney his views on gay marriage, and Romney gladly replied.

Jeanne Shaheen on Marriage Equality, Military Benefits | advocate.com

With the New Hampshire primary expected to take place 10 weeks from Tuesday, some presidential candidates are wasting no time in expressing solidarity with antigay forces who seek to repeal the state’s marriage equality law. Rick Perry was the latest to fall in line: On Friday, the Texas governor said in an address to Cornerstone Action that he applauds those “who are working to defend marriage as an institution between one man and one woman.”

But the repeal effort faces a certain veto from Gov. John Lynch and a lack of majority support among those living in the Granite State, where a National Guardswoman who recently returned from deployment was told last month that she was barred from bringing her partner to a Yellow Ribbon homecoming event.

Chief Warrant Officer Charlie Morgan was ultimately allowed to attend the event with her partner of 14 years after clarification from the Pentagon on available benefits (gay service member advocates want to see more extended), as well as a letter written on her behalf by New Hampshire senator Jeanne Shaheen to Secretary of Defense Leon Panetta. Morgan has since become one of several service members challenging the Defense of Marriage Act in a federal lawsuit filed last week.

A member of the Senate Armed Services Committee, Shaheen saw the Yellow Ribbon issue as a matter of common sense: A guardswoman allowed to serve openly post-“don’t ask, don’t tell” should, by default, be allowed to bring her family to an event that is geared toward “promoting the well-being of the National Guard and reserve members, their families and communities, by connecting them with resources throughout the deployment cycle,” according to a mission statement on the Yellow Ribbon Reintegration Program’s website.

Shaheen has cited the incident as further evidence on why a bill to repeal the Defense of Marriage Act that she has cosponsored is necessary. On Thursday, the Senate Judiciary Committee will begin debate on the bill, known as the Respect for Marriage Act, though its overall prospects in the current congressional session remain grim (“[T]ruthfully, the recourse to the courts is probably going to be the best approach,” President Obama said of DOMA in a September White House roundtable).

“There are two issues here: One is that DOMA specifically discriminates against gay and lesbian service members, and we need to challenge that,” Shaheen said in a telephone interview last week. “But there are a lot of rules and regulations that the military can review and make changes to without requiring legislation. Hopefully this incident will prompt them to clarify for people in the military what the circumstances are with respect to certain programs and events.”

Securing all benefits for gay service members not excluded by DOMA or provisions in the U.S. Code could be a possible topic of a future Senate Armed Services Committee hearing, Shaheen said, though she added that she is not aware of any current plans to do so. “I certainly think the committee can encourage the military to take the actions that they can, to implement a full repeal within the rules and regulations as expeditiously as possible,” she said. “I think if you look at the vote on repeal of ‘don’t ask, don’t tell,’ there are members of the committee that have good perspective on this.”

Though she had opposed marriage equality as Democratic governor of New Hampshire, Shaheen praised the 2009 passage of the state’s marriage bill and is now dismayed at the repeal effort by a faction of social conservative lawmakers. Last week, the New Hampshire House Judiciary Committee voted to advance a bill that would repeal the law and replace equal marriage rights with a form of civil unions.

“I’m very disappointed with the actions of the legislature — and I’m hopeful that they will not be successful,” Shaheen said. “These people represent the extreme right wing within this country. … I don’t think they represent the majority of the public.”

On marriage equality, Shaheen said she believed that DOMA repeal “provides an opportunity for states to address the issue,” as the 1996 law “currently acts as a disincentive for states to act independently.”

Asked about her own personal position, Shaheen said, “I do think [marriage rights for gays and lesbians] should be the case in every state. But I also think it’s important for states to decide the issue.”

Same- ​sex marriage equality is under extreme attack in New Hampshire, just 20 months after becoming legal. Tomorrow, Tuesday, New Hampshire’s House Judiciary Committee will take up a bill that would kill same-​sex marriage in New Hampshire, reports Jeremy Hooper at Good As You, who attributes the push to kill equality to “New Hampshire’s Cornerstone Policy Research — an organization that pushes “ex-​gay” therapy as its one and only homosexuality resource.” The bill would have to pass through the committee but “The full House will not vote on the bill until next year,” Igor Volsky at Think Progress notes.

The bill’s text actually notes that killing same-​sex marriage in New Hampshire will cost the state $50,500 next year and will reduce revenue to state and local governments every year after that.

Additionally, the bill automatically makes orphans and children whose parents have died or divorced second-​class citizens unworthy of the state’s protections (see image above.) It also falls into NOM’s, the National Organization For Marriage’s claptrap assumption that there are loving two-​person heterosexual homes available for every child born into this world.

HB 437 as currently written, “prohibits same sex marriages.” It is sponsored by: Rep. Bates, Rock 4; Rep. Kappler, Rock 2; Rep. Cebrowski, Hills 18; Rep. Sorg, Graf 3; Rep. Ulery, Hills 27; Rep. C. Vita, Straf 3; Rep. Silva, Hills 26; Rep. T. Smith, Merr 9; Rep. Gionet, Graf 3; Rep. Balboni, Hills 21; Sen. Groen, Dist 6; Sen. White, Dist 9.

The bill relays on the unconstitutional definition of marriage that proposes marriage is for the purpose of procreation:

The legislature finds and declares that:

I. Marriage is not a creature of statute but rather a social institution which predates organized government. As the United States Supreme Court has noted, marriage has roots that are “older than the Bill of Rights – older than our political parties, older than our school system.” Griswold v. Connecticut, 381 U.S. 479, 486 (1965).

II. As many scholars and experts have noted, marriage, understood as the legal union of a man and a woman, serves and supports important social goods in which the government of New Hampshire has a compelling interest.

III. The vast majority of children are conceived by acts of passion between men and women – sometimes unintentionally. Because of this biological reality, New Hampshire has a unique, distinct, and compelling interest in promoting stable and committed marital unions between opposite-​sex couples so as to increase the likelihood that children will be born to and raised by both of their natural parents. No other domestic relationship presents the same level of state interest.

IV. A child has a natural human right to the love, care and support of his or her own mother and father, whenever possible. Marriage is the primary social institution that promotes that ideal and encourages its achievement.

Volsky also notes,

“Polling shows that the move is unpopular among state residents, however. A WMUR Granite State Poll from October 14 found that voters want to keep marriage equality by a two to one margin. Just 8 percent said that the law had “a major effect on the state,” while 28 percent saw a “minor effect” and 47 percent saw no effect at all. Only 27 percent of New Hampshire adults said they support repealing same-​sex marriage, while 50 percent strongly oppose repeal.”

Despite Widespread Opposition, NH GOP Attacks Marriage Equality | truthwinsout.org

In 2009, the New Hampshire legislature voted to allow same-sex couples the freedom to marry. Since that time, support for marriage equality has only grown in the Granite State. In 2010, control of the legislature flipped to the GOP, and as a result, marriage rights for same-sex couples have come under attack from anti-gay extremist elements of the New Hampshire GOP.

This extremism flies in the face of public opinion. Newspapers have editorialized against efforts to overturn the state’s marriage equality law. A poll released earlier this month by the non-partisan University of New Hampshire Survey Center showed that 62% of New Hampshire residents oppose repealing marriage equality, with these results being nearly identical to those obtained in a February poll asking the same question. Even if you only count New Hampshire Republicans, support for overturning the law fails to win a majority.

Earlier this year, it looked as though New Hampshire Republicans were putting marriage repeal on the back burner when the House Judiciary Committee voted to push the issue to 2012. But Freedom to Marry is now reporting that a vote on the repeal bill is scheduled in the House Judiciary Committee for tomorrow, October 25. It looks as though despite strong and widespread public opposition, anti-gay extremists are indeed moving forward with their attacks on New Hampshire’s same-sex couples and families.

The next time you hear a marriage equality opponent spouting nonsense about “the will of the people” (as though minority rights should ever be subject to a majority vote…), tell them about what’s currently going on in New Hampshire. The truth is that wingnuts don’t care about the “will of the people,” only about imposing their will on the people.

Will gay marriage be repealed in NH? | 365gay.com

The New Hampshire House Judiciary voted this week to endorse a bill repealing the state’s gay marriage law and replacing marriages with civil unions.

Marriage equality has been the law since Jan. 2010. The new bill would reverse this and  would allow both straight and gay couples to form civil unions – unlike the first bill, which banned those as well. However, the bill also states that any individual, business, association or school could choose not to recognize civil unions.

The House can’t vote on the bill til 2012, says the NH Union Leader.

N.H. Wants to Keep Marriage Equality

Marriage Rings New Hampshirex 390 | Advocate.com

While efforts ramp up in Iowa to repeal that state’s marriage equality, a super-majority of residents in New Hampshire are happy to keep gay marriage on the books, according to a new poll.

A telephone poll conducted in January and February queried 520 people in New Hampshire on marriage equality — only 29% want same-sex marriage repealed, while 64% said they wanted to keep marriage rights for gay couples.

Republicans took over New Hampshire’s legislature in November, but state leaders decided any potential action on marriage wouldn’t happen until 2012.
